Recall issued on undeclared allergy in Marlyce’s Butterballs

On Behalf of | Jan 16, 2014 | Products Liability

Marlyce’s Butterballs are being recalled by L.M. Noodle Company because it did not declare milk, whey, wheat flour and soy flour allergy warnings on the packaging. If residents of Ohio have traveled to Colorado, Wyoming or Nebraska recently and bought a package of these butterballs, they need to check whether there is an allergy warning. Each plastic bag of 12 frozen butterballs has a white label with black lettering with a UPC of 094219-21708.

The ingredients in butterballs include bread crumbs, butter, cream, eggs, salt and allspice, all of which are rolled into a ball and placed in a soup to cook. People who are allergic to milk, whey, wheat flour and/ or soy flour could be at risk of a serious allergic reaction if they eat these. So far, L.M. Noodle Company has not received any reports of illnesses caused by the undeclared warning.

The Food and Drug Administration discovered the undeclared allergens during an inspection, and the recall was immediately issued. Butterball packages that were still in the warehouse were relabeled, along with products that were still stocked in retail stores. They were sold in five Colorado stores, two Wyoming stores and five Nebraska stores. The allergen label was added to the lower left corner of the package. People who bought the butterball packages without the allergen label are encouraged to return them for a full refund.

All kinds of consumer goods may be found harmful to people, and product liability laws require companies to protect consumers from defective and dangerous goods by issuing recalls of the products if they do not meet certain standards. If someone dies as a result of a defective product that wasn’t the subject of a recall, the survivors of the victim may be entitled to compensation through a wrongful death claim against the company.
