Car accidents can have tragic endings when they occur on city streets in Cleveland, or on interstates that connect suburbs to rural areas. When they occur when people are at home, they are far more troubling. People sitting at home are supposed to be safe from the dangers that riding in a car brings. For a couple on Cleveland’s Wade Park Avenue, that danger ended up being fatal.
A car crashed into the home, causing severe damage and killing two people. The accident occurred around midnight.
According to police, the car careened off of Wade Park Avenue, hit a tree and flew into the air. The car crashed into the second floor of the home. The owner of the home was trapped, and eventually lost her life before first responders could rescue her.
From a legal standpoint, driver of the car has a legal duty to use reasonable care while behind the wheel. This means that he (or she) must use the type of care that a normal driver would use to avoid such a calamity. If a driver breaches this duty, and an accident ensues, the driver could be held liable for the damage caused, as well as the injuries suffered.
Moreover, the driver could be held responsible for the deaths that occur. The surviving family members could bring a wrongful death lawsuit to compensate for the loss of companionship, emotional distress, and loss of income (when applicable).
In the meantime, police are still investigating the crash to determine how a car could have made such a crash.
