Sometimes, pharmaceutical litigation in Ohio involves large class action lawsuits against drug companies. Other times, though, such lawsuits are more personal in nature, but that does not mean they are any less important. In another state, a legal complaint against Walgreens alleges just such a dangerous medication mistake. A mother has filed a lawsuit on behalf of her minor daughter claiming that the pharmaceutical chain gave her daughter the incorrect prescription, not just once, but twice. The first incident took place in Sept. 2016 when the woman picked up a prescription for her daughter’s seizures at one Walgreen’s location. The pharmacists there allegedly gave the mother the wrong medication, but this fact was not discovered until after the child had taken the medicine and began to display symptoms of an overdose, for which she had to be taken to a hospital for treatment.
Upsettingly, a similar incident allegedly occurred the following May at a separate Walgreen’s location when, after returning home with her daughter’s prescription, the woman discovered that the medication bottle contained two different types of pills. The mother subsequently secured legal representation and filed a lawsuit. The complaint alleges negligence on behalf of the defendant and the defendant’s employees when they incorrectly filled the prescriptions, did not exercise proper care, and failed to warn of the danger the daughter was in.
The lawsuit does not name a specific amount in damages and instead seeks all legal fees and reasonable sums due. Frighteningly, the medication errors that injured the woman’s daughter are far from uncommon, and sometimes the results are fatal. Any residents of Ohio who have similarly suffered drug injuries or who have lost loved ones due to a pharmaceutical error should know that they do not have to suffer in silence.
